Returns and Exchange

Objective

The objective of this policy is to provide all clients of Atticus Private Equity (Pty) Ltd (‘Atticus’) with the necessary guidelines as to the company’s returns policies and procedures with regards to products purchased by the clients from Atticus.

 

Consumer Protection Act and ‘cooling-off’ period  

Atticus values its clients and endeavours to provide the best possible service to same. In doing so, we take due consideration of your rights in terms of the Consumer Protection Act, no 68 of 2008 (the ‘Act’) are protected.

In doing so, Atticus:

  • Ensures to provide its clients (in accordance with the Act) with goods that:Are reasonably suitable for purpose which they are generally intended; 
    • Are good quality, in good working order and free of defects; 
    • Will be useable and durable for a reasonable period of time having regard to use for which they would normally be put and to all surrounding circumstances of their supply; 
    • Comply with applicable standards in Standards Act, 1993 or other regulation. 
  • Does not marketing its products fraudulently, or in a misleading or deceptive manner; 
  • Complies with all other relevant conditions of the Act. 



As a gesture of our commitment, we offer our clients an extended ‘cooling-off’ period of 14 (fourteen) days from receipt of the products. Refunds will made in the same manner as payment was received (unless mutually agreed to otherwise), within 7 (seven) days of receipt of the product(s), subject to any shipping, freight or courier costs that may apply. You must advise us in writing of your cancellation and any such cancellation must be signed by the person who made the original purchase. Items of a personal nature cannot be returned (Jewellery, clothing, etc). Only items that are unopened in their original packaging may be returned. Not all returns or cancellation requests will be granted.

 

Returns as a result of Defects

General Warrenty: 

If, within 6 months after delivery of a Product to you:

  1. you find that the Product is defective/faulty, unsuitable for the purpose generally intended, or not legal or reasonably durable (“Defective”); and
  2. you arrange to return such product to Atticus for inspection  in accordance with the Procedure for Returns set out below, and the Product is subsequently found:
  3. (i)to indeed be Defective, you are entitled to (at your selection) either (a) be fully refunded, or(b) have the product(s) repaired or replaced at Atticus’ expense (the decision between repairing or replacing being that of Atticus’ depending on availability and other relevant considerations); 
  4. (ii)NOT to be Defective, you will not be entitled to any repair, replacement or refund but will instead be liable for the costs incurred in having such product(s) returned to Atticus and then re-delivered to you.
  5. (b)the above repair, replacement or refund will not apply to products that are not deemed to be Defective, such as those with damage caused by normal wear and tear, or arising from incorrect usage of the product(s).

 

Manufacturer's warrenty:

Atticus products are subject to a further manufacturer’s warranty (or guarantee), which will be clearly stated on the product packaging. Such manufacturer’s warranties apply mutatis mutandis with the General Warranty set out above.

 

Procedures for Returns:

Kindly contact our head office by way of email to either info@atticus.co.za or sales@atticus.co.za:

  2. (a)The product(s) intended for return; 
    (b) A copy of the invoice relevant to the purchase of the product(s)
    (c)The reason for the return under this policy document (i.e. ‘cooling-off’ period, defective product or other).
  3. One of our service consultants will then contact you to make arrangements in respect of the return of the product(s).
  4. Please note that, save for where the product is found to be defective, you will be required to deliver the goods to be returned to our head office (26 Thora Crescent, Wynberg, Sandton, Tel: 011 027 7528). Our service consultants will happily assist you with the collection or courier of the products from you, subject to a reasonable fee in this regard.
  5. We request that you ensure that the product(s) to be collected are packed so as to comply with the following:
    (a) a copy of the invoice  relevant to the purchase of the product(s) is attached to the product(s); 
    (b) the product(s) are properly protected, within their original packaging, and, save where being returned due to being Defective, are still in perfect condition for the purposes of   resale (ie not damaged or used in any way), together with any accessories, instructions and documentation. 

Should such product(s) not be in the condition mentioned above, the client will be liable to pay Atticus a reasonable fee, as is necessary to restore the product(s) in the duly required condition for resale. 

 

Cancellation of Orders

Cancellation of orders for product(s) outside of the mandate for return of product(s) in accordance with the Act and as set out above in this Policy document, will attract a 20% (twenty per centum) charge for administrative and related expenses payable by the client to Atticus.
